About this manual

This manual is published in terms of Section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It explains how members of the public may request access to records held by the ANC Free State Caucus.

The following records are published on this website and available without a formal PAIA request:

  • Member profiles and contact information
  • Parliamentary Constituency Office (PCO) directory
  • Committee meeting schedules and published minutes
  • Legislative tracker (bills and their progress)
  • Hansard excerpts and press statements
  • Departmental scorecards and oversight reports
  • This PAIA manual and the Privacy Policy

4. Records held by the Caucus

The Caucus holds the following categories of records, which may be requested under PAIA:

5. Records protected from disclosure

Certain records are exempt from disclosure under PAIA, including:

  • Records protected under Section 34–38 of PAIA (third-party privacy interests)
  • Personal information of individuals, protected under POPIA Act 4 of 2013
  • Records relating to the safety and security of individuals
  • Legally privileged communications (solicitor-client privilege)
  • Information whose disclosure would cause unreasonable harm to the Caucus's legitimate interests

6. How to request records

To request access to records under PAIA:

  1. Complete the prescribed PAIA Form C (available from the Information Officer or the SA Human Rights Commission).
  2. Submit the completed form to the Information Officer by hand, post, or email (see Section 1 above).
  3. Pay the prescribed request fee (see Section 7 below).
  4. The Information Officer will respond within 30 days of receiving your request. An extension of up to 30 days may apply in complex cases.
Required information in your request

Your request must include: your full name and contact details, a description of the records requested, the form in which you prefer to receive the records, and the reason for the request (if applicable).

Fees are prescribed by the Minister of Justice and may be updated. Fees are waived for requests made in the public interest, at the discretion of the Information Officer.

8. Appeal against refusal

If your request is refused, you may:

  1. Apply to court — under Section 82 of PAIA, you may apply to the High Court to review the decision. This must be done within 180 days of receiving the refusal.
  2. Complain to the Information Regulator — under Section 77A of PAIA (as amended by POPIA), you may lodge a complaint with the Information Regulator of South Africa: inforeg@justice.gov.za.

Your privacy matters

The ANC Free State Caucus is committed to protecting your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA). This policy explains what we collect, why, and your rights.

2. Personal information we collect

We collect personal information only when you voluntarily provide it — specifically through the Constituency Query Form on our Contact page. This may include:

  • Full name and surname
  • Contact telephone number
  • Preferred contact method (phone/email/WhatsApp)
  • Subject and description of your constituency query
  • Your selected district and MPL

We do not collect sensitive personal information (such as race, health status, or political affiliations beyond your use of this site) without separate, explicit consent.

Our website does not use cookies to collect personal data. Browser storage is used only for your accessibility preferences and language selection (see Cookies & Storage tab).

3. Purpose of collection

We collect personal information for the following specific purposes:

  • To route your constituency query to the correct Parliamentary Constituency Office (PCO)
  • To allow the MPL or PCO staff to follow up with you
  • To generate a reference number for your query
  • To track and report on constituency service delivery (in anonymised aggregate form)

We will not use your personal information for any purpose other than those stated above without your consent.

4. Legal basis for processing

We process your personal information on the basis of:

  • Your consent — you provide information voluntarily via the constituency query form, and are required to tick a POPIA consent checkbox before submitting.
  • Legitimate purpose — constituency representation is a core function of elected MPLs under the Constitution of the Republic of South Africa.

5. How we share your information

Your personal information may be shared with:

  • The relevant MPL and PCO staff needed to address your query
  • The Free State Legislature administration for official record-keeping purposes

We do not sell, rent, or share your personal information with commercial third parties, political campaigns, or external organisations without your consent. We do not transfer personal information outside the Republic of South Africa.

6. How long we keep your information

Constituency query records are retained for 3 years from the date of submission, in line with the Legislature's records management policy. After this period, records are securely deleted or anonymised.

Accessibility and language preferences stored in your browser's local storage remain until you clear your browser data or reset them on the Accessibility page.

The submission of a constituency query is entirely voluntary. You are not obliged to provide any personal information to access information on this website. The only information required for a constituency query is what is necessary to route and respond to your query.

What we store and why

We use your browser's localStorage (not cookies) to save two types of preference:

Third-party resources

This website loads the following resources from third-party servers:

  • Google Fonts (fonts.googleapis.com / fonts.gstatic.com) — loads the Playfair Display and Source Sans 3 typefaces. Google may set its own cookies or log your IP address in accordance with Google's privacy policy. We are exploring self-hosting these fonts to eliminate this dependency.

No other third-party scripts, iframes, or embeds are loaded by default.

Managing your stored data

You can manage or clear your stored preferences at any time:

  • Accessibility preferences — click the ♿ accessibility button (bottom-right) and select "Reset to defaults", or visit the Accessibility Tools section.
  • Language preference — switch back to English using the language selector in the top navigation bar.
  • All stored data — clear localStorage entirely via your browser's developer tools or privacy settings (Settings → Privacy → Clear browsing data → Site data).

Do Not Track

This site honours the Do Not Track (DNT) browser signal. When DNT is enabled, no localStorage preferences are written (your settings will not be remembered between sessions).
